ASSIGNMENT OF GOLF CART SHEDS

On an annual basis the RHGC shall lease to qualifying Members of RHGC the Cart Sheds that have been made available by Saudi Aramco to RHGC and are in useable condition at the RHGC facilities. However, Saudi Aramco reserves the right to direct RHGC to hold/reserve a number of Cart Sheds from being leased and RHCG will not entertain leasing these withheld Cart Sheds until such time as it receives authorization to proceed in leasing these Cart Sheds.

I. Qualifications

Qualification Requirements for the lease of a Cart Shed

  1. Only RHGC Regular Members as defined by the Rolling Hills Golf Club Constitution are eligible to rent Cart Sheds.
  2. Only RHGC Regular Members defined as Primary Members in the RHGC Membership Records are eligible to rent Cart Sheds.
  3. Only RHGC Regular Members defined as “Active Golfers” are eligible to rent Cart Sheds. The RHGC Board of Directors has defined “Active Golfers” to be those Regular Primary Members who have paid their Annual Green Fees (the Green Fees) to Saudi Aramco to play golf on the Rolling Hills Golf Course for the same fiscal year as that for the Cart Shed.

II. Agreement

Execution of Annual Cart Shed Lease Agreement

  1. Those RHGC Members who are in good standing with an existing Cart Shed Lease Agreement and will fulfill this lease agreement in good standing for the entirety of the current year will qualify for the renewal of this lease agreement for the subsequent year. Prior to the end of the current year, these qualifying Members must evidence renewal of their Cart Shed Lease Agreement for the subsequent year without any alterations or amendments to the lease agreement (excepting the time period for which this agreement will apply).
  2. Those RHGC Members who become eligible to lease a Cart Shed from RHCG after the beginning of the current year must execute a new Cart Shed Lease Agreement with RHGC whereby the term of the agreement will be for the remainder of the current year. Other than this modification to the term of the agreement to reflect the date upon which it is executed, no other alterations or amendments to the Cart Shed Lease Agreement will be allowed.
  3. Failure to execute an unaltered Cart Shed Lease Agreement will result in forfeiture of the right to rent a cart shed and the qualifying Member will be asked to immediately vacate the cart shed applicable to the lease agreement if this cart shed is occupied.
  4. Regular Primary Members shall be required to show proof of payment of the Rolling Hills Green Fees for the period covered by the Cart Shed Lease Agreement before the execution of this agreement will deemed to be valid.

III. Payment

Payment of Annual Cart Shed Dues

  1. Full Year Term Payments - For those Members of RHGC qualifying for the lease of a Cart Shed for a full year term the following payment rules apply:
    1. Annual Cart Shed Dues shall be based on the RHGC Fiscal Year which is January 1 to December 31.
    2. Annual Cart Shed Dues are payable on or before December 31 for the upcoming Fiscal Year.
    3. Annual Cart Shed Dues not paid by January 31 of the current Fiscal Year will be considered a breach of the Annual Cart Shed Rental Agreement resulting in the immediate loss of the Cart Shed and the requirement to immediately vacate the Cart Shed.
  2. Partial Year Term Payment - For those Members of RHGC qualifying for the lease of a Cart Shed for a partial year term the following payment rules apply:
    1. Annual Cart Shed Dues shall be based on the RHGC Fiscal Year which is January 1 to December 31.
    2. The Cart Shed Dues for a Partial Year Cart Shed Lease Agreement will be the same as the Annual Cart Shed Dues. No proration of these dues will be made to adjust for the date upon which the Cart Shed Lease Agreement is executed.
    3. The payment for Cart Shed Dues for a Partial Year Cart Shed Lease Agreement must be made in full within 15 days of the valid execution of the Partial Year Cart Shed Lease Agreement. Any dues not paid in full within this 15 day period will be considered a breach of the Partial Year Cart Shed Rental Agreement resulting in the immediate loss of the Cart Shed and the requirement to immediately vacate the Cart Shed.
